TERMS AND CONDITIONS

1. Exclusivity

The Client acknowledges and agrees that the Photographer will be the exclusive provider of the Services unless otherwise agreed upon in writing by both parties.

2. Fees and Payment

  • A non-refundable retainer is required at the time of booking to secure the session.
  • The remaining balance must be paid in full on or before the day of the session.
  • The retainer secures the Client’s time slot and is non-refundable under any circumstance.
  • All payments are non-refundable once made, except in the case of a cancellation by the Photographer.

3. Cancellations and Rescheduling

  • The Client may cancel or reschedule the session with a minimum of 7 days' notice before the scheduled session date.
  • Cancellations made less than 7 days before the session will result in the forfeiture of the retainer and any payments made.
  • Rescheduling is allowed once, subject to the Photographer’s availability.
  • In case of Photographer illness, emergency, or force majeure (e.g., weather, studio/location issues), the Photographer reserves the right to reschedule the session.

4. Copyright and Usage Rights

  • The Photographer retains full copyright ownership of all images and video content.
  • The Client is granted a personal and business-use license, allowing printing, social media use, and marketing for their own business.
  • The Client may not sell, significantly alter, or redistribute the content beyond the agreed usage.
  • The Photographer may use the images and videos for promotional purposes (website, portfolio, social media), unless the Client requests otherwise in writing.

5. Liability and Limitations

  • The Photographer is not responsible for missed shots or footage due to client behavior, tardiness, or non-cooperation.
  • In case of technical failure or unforeseen circumstances, the Photographer’s liability is limited to a full refund of all payments received.

6. Client Responsibilities

  • The Client agrees to arrive on time and prepared. Tardiness will reduce the total shooting time.
  • The Client is responsible for communicating styling, outfits, and any special requests in advance.
  • The Client must respect studio/location rules and conduct themselves professionally.
